These Terms of Service ("Terms") govern your use of BuildAndHost services. By using our services, you agree to these Terms.

Services

BuildAndHost provides:

• Website design and development
• Website hosting and maintenance
• Domain management assistance
• Ongoing technical support

Pricing and Payment

• Setup fees are due before work begins
• Monthly hosting fees are billed on the same date each month
• Payments are processed through Stripe
• Late payments may result in service suspension after 7 days notice

Service Tiers

We offer multiple service tiers with different features and limits. Your specific tier and pricing are outlined in your service agreement.

Your Responsibilities

You agree to:

• Provide accurate business information
• Provide content and images for your website (or approve content we create)
• Respond to our communications in a timely manner
• Not use our services for illegal purposes
• Not upload malicious code or content

Our Responsibilities

We agree to:

• Build your website according to agreed specifications
• Host your website with 99.9% target uptime
• Perform regular backups of your data
• Provide technical support via email
• Maintain security updates on our servers

Intellectual Property

• Your content: You own all content you provide (text, images, logos)
• Website code: We retain ownership of underlying code and templates
• Your website: You have full rights to use your website while subscribed

Cancellation

• You may cancel at any time with 30 days notice
• No refunds for partial months
• Upon cancellation, we will provide your content upon request
• Website will be taken offline after service ends

Limitation of Liability

BuildAndHost is not liable for:

• Loss of business or revenue due to website downtime
• Third-party service outages (domain registrars, payment processors)
• Content you provide that infringes on others' rights
• Damages exceeding the amount paid for services in the past 12 months

Indemnification

You agree to indemnify BuildAndHost against claims arising from:

• Content you provide
• Your use of the website
• Violation of these Terms

Modifications

We may modify these Terms at any time. Continued use of our services after changes constitutes acceptance of new Terms.

Governing Law

These Terms are governed by the laws of the State of Michigan.
